Rule Amendments

 

Notice of BAP Local Rules Amendment and Request for Comments

Pursuant to 28 U.S.C. §2071(b), and 6th Cir. R. 47(d), the Bankruptcy Appellate Panel for the Sixth Circuit (“BAP”) hereby provides notice that it has adopted amendments to its rules effective December 15, 2014, and seeks public comment on those amendments. Federal Rules of Appellate Procedure

Effective December 1, 2014 the Federal Rules of Appellate Procedure have been amended to include changes to Rule 6. Those changes have been incorporated into the Rules as posted here. Amended Rules

Electronic Payment

Starting August 1, 2014 the Court will be accepting the electronic filing via CM/ECF of petitions for review, original petitions, and applications for attorney admissions.

Additionally, CM/ECF filers will be able to make online credit card or ACH payments for the following fees:
  • Docketing Fees
  • Notice of Appeal from the Bankruptcy Appellate Panel
  • Admission of Attorney
  • Certificate of Good Standing
  • Instructions on how to make online fee payments may be found at http://www.ca6.uscourts.gov/internet/electronic_payment/electronicpay.htm

    Adoption Of Docket Numbering
    Effective March 24, 2014, the entries on the court’s dockets, available through PACER, will be numbered. The court has adopted the numbering convention for easier review and reference to docket entries. On some existing dockets, gaps may appear in the numbering sequence. These are not errors or deletions. Rather, this is due to the fact that prior to January 1, 2014, all events, even internal purely administrative entries, received a number. Any gaps represent non-public technical entries. Any questions may be directed to the Clerk’s Office. After January 1, 2014 only public entries were assigned numbers.

    Increases to the Fee Schedule
    At its September 2013 session, the Judicial Conference approved several changes to the Court of Appeals Miscellaneous Fee Schedule. Changes include an increase of the appellate filing fee, referred to as the “docketing fee” in the schedule, from $450 to $500. The Conference also adopted an increase to the cost of retrieving records that are stored away from the court's place of business. More Information

    Electronic Filing - Immigration Administrative Records

    By administrative order, the Court has authorized the electronic filing of administrative records in petitions for review of decisions of the Board of Immigration Appeals. More Information

    Policy Change: Electronic Devices

    The United States Court of Appeals for the Sixth Circuit has posted its current policy on the use of electronic devices. More Information

    Reduction in Compensation for CJA Counsel
    As a temporary, emergency measure, the Judicial Conference has reduced by $15 per hour the hourly compensation rate for counsel appointed under the Criminal Justice Act. The reduction applies to all work performed in capital and non-capital cases from September 1, 2013 though March 1, 2014. For work performed in capital federal post-conviction proceedings, the maximum hourly compensation rate will be $163. For work performed in non-capital cases, the maximum hourly compensation rate will be $110. Other compensation limits remain unchanged.

     

     

    Bankruptcy Appellate Panel

     

    BAP Adopts Electronic Filing
    Effective April 1, 2010, all filings by attorneys in appeals to the Bankruptcy Appellate Panel of the Sixth Circuit are to be made electronically through ECF. The rules of the BAP have been amended effective April 1, 2010, and counsel should refer to these, and to the Guide to Electronic Filing referred to therein and linked below, when making filings with the BAP.
