Updates to Appellate Rules and Miscellaneous Fee Schedule Effective December 1, 2016

On December 1, 2016, significant changes to the Federal Rules of Appellate Procedure (FRAP) will take effect. Click here for a summary of the major FRAP changes. A redline version of the FRAP Amendments is available here. The Miscellaneous Fee Schedule has also been amended, and fee changes will be effective December 1.

Please be advised that the Sixth Circuit Court of Appeals has not amended its rules and will apply the changes in the FRAP. All documents filed after December 1, 2016 should comply with the new word and page limitations, regardless of any language to the contrary in briefing letters forwarded earlier in the case. Litigants in all case pending as of December 1, 2016 who seek an increase in the word limitations must do so by a supported motion for enlargement of the applicable word limits.
